The Other Theatre Company presents The Merchant of Venice in Albury | The Border Mail

LIVE theatre will return to Albury Botanic Gardens on Friday after a prolonged absence amid the coronavirus crisis. The Other Theatre Company will present a retelling of William Shakespeare’s comedy The Merchant of Venice over two weekends. Actor Darby Quinlivan said the play got an epic, retro overhaul. “It’s set in the 1980s so it will be immediately more recognisable to the audience,” he said. “For those not around in the 1980s, they’ll definitely be familiar with the pop culture references. We’re drawing from the yuppy culture, particularly as told through the love story.” IN OTHER NEWS: Quinlivan, who plays moneylender Shylock, said two dozen cast and crew had rehearsed since November. “Due to the pandemic we’ve had some rehearsals in the gardens from the start,” Quinlivan said. Malaysia Top E-Commerce Merchant Awards 2020 is platform to nurture e-commerce industry


  • 458 participants in 5 years, generating US$13.5mil in gross merchandise value
  • Platform for e-commerce players to learn, network, grow with one another

E-commerce is experiencing a boom in Southeast Asia. The Covid-19 pandemic is massively altering shopping behaviour, leading people to fill online shopping carts rather than physical ones. Digitally transforming a business, even in small steps, can prove vital to survive in the new normal.

As such, it’s important for businesses to understand the full significance of embracing e-commerce. Granted, diving so quickly into the deep end may seem overwhelming, if not outright terrifying. Where do we even begin? How do we scale? How do we ensure that we’re on the right path?

If anything, the upcoming Malaysia Top E-Commerce Merchant Awards (Top ECM) may be a handy guide. The event, organised by the Selangor Information Technology and E-Commerce Council (SITEC), awards the country’s most creative and innovative homegrown e-commerce merchants.

These merchants are judged based on their products, platforms, visibility and promotion, and business potential, as well as how well they performed during the Online Sales Contest that is happening from today, 3 Nov, up till 16 Nov.

Malaysia Top E-Commerce Merchant Awards 2020 is platform to nurture e-commerce industryIn short, these are some of the best e-commerce merchants to thrive online, with approach to products, sales and marketing that can be prime areas for learning.

Since its inception in 2016, a total of 458 merchants have participated in Top ECM, generating US$13.5 million (RM56 million) in gross merchandise value. The number is growing exponentially – this year, the competition received a record-breaking 162 applications, which is 27% more compared to the 128 applicants of 2019.

After careful consideration, 123 applicants were shortlisted to the final for Top ECM 2020.

These are reputable, established merchants. Top ECM only takes applications that meet the minimum threshold of US$6,000 (RM25,000) in sales or 100 orders per months. Past winners include the likes of Sally Fashion, Printcious, Sea Gamer Mall and Hermo.

Top ECM features two categories of awards, namely Top E-Commerce Merchant Awards and Selangor E-Commerce Merchant Awards. The winners will be able to take home RM40,500 in cash prizes and other prizes this year – almost double that of 2019.

An evolving contest

The rise in participants is a clear reflection of the expanding e-commerce sector in Malaysia, which has been exacerbated by the movement control order (MCO) imposed in March, and, more recently, the conditional MCO (CMCO) reinstatement in Sabah and the Klang Valley.

The participants also paint a picture of the nation’s e-commerce sector. For one, 60% of the participating e-commerce merchants are from Selangor, which indicates the state’s growing status as the nation’s e-commerce hub.Malaysia Top E-Commerce Merchant Awards 2020 is platform to nurture e-commerce industry

This is followed by Kuala Lumpur and Johor, which contributed 15% each to the total number of applicants.

While Covid-19 may have slowed down the fashion industry, the segment does make up 25% of the total participants. This is followed by the Mobile, Electronic & Gadgets segment with 20%, Health & Beauties (15%), Home & Living (10%) and Grocery (8%). The remaining 12% consist of e-merchants from Sports, Mum & Baby, Automotive and Ticketing Segments.

The trend, however, is seeing some shifts. The sudden increase of Grocery e-merchants – which grew from 2% in the previous year – shows just how much the Covid-19 pandemic has affected the way we embrace the low-touch economy.

“Over the past years, the representation of the participants has clearly indicated the diverse e-Commerce growth and its dynamism as representation from various industries, small to big companies, seller focusing on local to international markets, Omni-channel/O2O model and more,” says ClickAsia.com chief executive officer Sunny Ooi, who is also a committee member of the Internet Alliance (IA).

 

Nurturing e-commerce

IA has been collaborating with SITEC as a promotion partner to forward the Top ECM Awards information to their members, as well as clients of the members who are in the e-commerce space to encourage participation.

Additionally, the president of the IA is also part of the panel judges that evaluate and assess the award entries.

The Top ECM Awards may have attractive prizes to incentivise participation, but the awards ultimately is here to foster e-commerce growth and adoption. “In my opinion, SITEC has done a great job in bringing out the best of e-commerce players throughout the past years, and nurture many of the young start-ups to become established players today,” says IA president Tan Tuan Kai.

“Despite of our small domestic market, some of these e-commerce players have started to grow beyond Malaysia and ASEAN, which in turn would help Malaysia to be a future power house in e-commerce. SITEC has made remarkable achievement in making the annual ECM award to become a premier annual event for the tech industry in Malaysia where Internet Alliance is a proud supporter”, he adds.

Furthermore, the Top ECM awards serves as a platform for e-commerce players to benchmark against the industry’s best, and grow from there. “E-commerce is relatively an industry where it involves many dimensions from digital contents/creatives, social media marketing, online fulfilments/operation, customer service and engagement, online brand equity, Go-to-market business model – own brand.com store, marketplaces or social commerce platform or more,” begins Sunny.

“So, the finalists or participants represent their significant strengths and contributions in some if not all of the areas.  This competition is indeed a good platform for many emerging e-Commerce players to come forward not just to compete but rather to benchmark against the industry best. This is perhaps the best way to learn, network from each other and helping to Malaysia E-Commerce industry.”

Ooi, who adds that Top ECM has been associated with the “Oscars” awards in the realm of Malaysia’s e-commerce industry since inception,  says that the nation’s e-commerce industry has progressed from its initial nascent stage into the growth stage with the push from Covid-19.

“We firmly believe the next wave of e-commerce growth will comprise of many new entrants from traditional SME and retail industry joining this Digital Disruption journey,” he says.

There will be much to learn from the Top ECM participants this year. Each contestant is busy into the Online Sales Contest, which begins today up to 16 Nov. Consumers can expect discounts and promotions during the period, which coincides with the 11.11 Sale. Come for the discounts, stay for the competition.

After going all in on Amazon, a merchant says he lost everything


In blogs and news releases, Amazon highlights the success of these merchants as a win-win. Lost in the public-relations glare are merchants like Govani.

Stories like his have swirled for years in online merchant forums and conferences. Amazon can suspend sellers at any time for any reason, cutting off their livelihoods and freezing their money for weeks or months. The merchants must navigate a largely automated, guilty-until-proven-innocent process in which Amazon serves as judge and jury. Their emails and calls can go unanswered, or Amazon’s replies are incomprehensible, making sellers suspect they’re at the mercy of algorithms with little human oversight.

Recourse is limited because when merchants set up shop on Amazon, they waive their right to a day in court by agreeing to binding arbitration to resolve any disputes. Amazon doesn’t negotiate terms with merchants. The boiler plate agreement is take-it-or-leave-it, a telling reminder of who has the upper hand in the relationship.

How Amazon treats third-party sellers is at the heart of a recent House Judiciary Committee report concluding that big technology companies often abuse their power over smaller partners. The committee’s recommendations include providing adequate recourse to sellers and eliminating forced arbitration clauses from contracts that deprives them from filing a lawsuit.

“Because of the severe financial repercussions associated with suspension or delisting, many Amazon third-party sellers live in fear of the company,” the report states. “This is because Amazon’s internal dispute resolution system is characterised by uncertainty, unresponsiveness and opaque decision-making processes.”

In an emailed statement, an Amazon spokeswoman said the company works hard to ensure products sold on its site are authentic and provides a fair dispute resolution process.

Govani has been selling clothes for more than 20 years, mostly brands like Hugo Boss, Calvin Klein and Lucky. About a decade ago, he began supplementing his store sales by putting merchandise on web marketplaces including Amazon and eBay. Amazon emerged as the most effective partner, accounting for more than 90 per cent of his online sales.

Initially, Govani stored, packed and shipped all the orders himself, paying the company a commission on each sale. Amazon representatives suggested he try Fulfillment by Amazon, a service that handles that for additional fees. Govani decided to send all of his inventory to Amazon, becoming one of 450,000 businesses to try the service in the year ending May 31.

Govani’s problems began soon afterward. In April, Amazon emailed him to say his account was being reviewed based on four customer complaints over “inauthentic” products.

“In order to ensure that customers can shop with confidence on Amazon, we take ‘inauthentic’ complaints seriously,” the message said. “The sale of counterfeit products on Amazon is strictly prohibited.”

One complainant from was unhappy with the fit of a $US125 Lucky Moto jacket and said she was “wondering if this was a fake.” Govani refunded her money and explained that jackets made with different materials fit differently.

Another shopper was upset that his Calvin Klein underpants arrived in a damaged carton. “Box is pretty much broken, the item is a knock off,” the shopper said in a product review. It’s not clear why Amazon characterised the other two complaints-about apparel wrapped in tissue paper and shipped in envelopes-as “inauthentic.”

Govani appealed the suspension and submitted invoices from the brands to Amazon. His invoices were more than a year old because that’s when he had purchased the inventory, but Amazon wanted invoices from the previous 365 days. Govani was notified that his inventory would be destroyed if he didn’t reclaim it by mid-July. Merchants must pay Amazon additional fees for inventory removal.

Hoping to have his account reinstated and continue selling on the site, Govani put off the decision. He received a total of 11 emails from Amazon each giving him different dates at which time his inventory would be destroyed if he hadn’t removed it. He sought clarity from Amazon about the conflicting dates. When he tried to submit an inventory removal order through Amazon’s web portal, it wouldn’t let him.

The spokeswoman said Amazon repeatedly asked Govani to provide evidence that the products sold were authentic but that the invoices he sent were either illegible or didn’t match the records of the brand owners. “After being unable to resolve the matter following several appeals as part of our dispute resolution process, we informed this seller six separate times that they needed to remove their inventory from our store by specific dates or it would be destroyed,” she said. “The seller failed to request to remove their inventory by the dates provided.”

At the end of July, Govani sent a panicked email to chief executive officer Jeff Bezos. He exchanged emails with an Amazon representative named “Brigitte M.,” who promised to investigate. Brigitte M. gave her final response on August 3, reiterating that there was nothing else she could do.

Amazon has been more aggressive in using algorithms to knock suspected counterfeits off the site, and consultants say Govani’s experience is common. Chris McCabe, a former Amazonian who now helps merchants navigate the appeal process, says suspensions based on complaints about inauthentic products are rising and often lodged by rival merchants looking to sabotage a competitor.

“Numerous sellers find themselves appealing this endlessly only to hear that their invoices aren’t acceptable or their suppliers aren’t verifiable, but without any indication as to why,” said McCabe, who testified before the House panel. “Or they receive no reply.”

If Amazon declines to reimburse Govani for his inventory, his next step is binding arbitration, which the House panel said gives Amazon the upper hand in disputes. From 2014 to 2019, only 163 Amazon merchants initiated arbitration proceedings against the company because “sellers are generally aware that the process is unfair and unlikely to result in a meaningful remedy,” the report states.

Govani’s attorney Mario Simonyan, who has represented other Amazon sellers in similar disputes, suspects the company will make a lowball offer, forcing Govani to decide if he wants to pay for arbitration, which can cost tens of thousands of dollars.

Govani said he is eager to start a new business in an entirely new field-possibly construction-even though he spent his career in retail.

“I don’t want to go back to online retail even though it’s the only thing I’m good at,” Govani said. “I’m so scared to sell on Amazon. This has been traumatising.”

‘Hostile’ Fyshwick scrap metal merchant ordered to pay nephew $532,365 after crane accident | The Canberra Times

A truck driver and labourer has successfully sued his “hostile” and bankrupt uncle for more than $500,000 after a crane knocked him off the back of a truck and caused him “very nasty” injuries. Justice David Mossop ordered in the ACT Supreme Court on Wednesday that scrap metal merchant William Martin pay his nephew Donovan Hall $532,365 in damages. The judgment reveals that Mr Martin, who operated a yard in Fyshwick, employed Mr Hall on a cash-in-hand basis for about two weeks prior to the incident and did not have workers compensation insurance. On January 30, 2016, he tasked Mr Hall and another employee, Paul McDonald, with making a delivery to his farm in Tarago, near Goulburn. At the farm, Mr Hall was standing on the back of a truck when the beam of a crane operated by Mr McDonald hit him in the face. The blow knocked him to the ground, shattering his left kneecap. During a hearing in July, he told the court Mr Martin was aware of the incident moments after it happened. He said when he went to the scrap metal yard on crutches and raised the possibility of a civil claim, Mr Martin told him “you won’t get nothing out of me”. Since the incident, Mr Hall said, he had been unable to keep a job because of the pain in his knee. However, Mr Martin denied that Mr Hall or Mr McDonald had ever worked for him. Despite this, he could not recall the name of a single employee from the 2015-16 financial year. He claimed Mr Hall had never even been to the Tarago farm, and said of the civil claim: “This is a blackmail on me because I might have a few quid for them to get and tell lies about. That’s what it’s all about.” The court heard that despite Mr Martin having operated the scrap metal yard, he had been bankrupt since 1999. Mr Martin’s son, Dean, who lives at the Tarago farm, told the court he was adamant that he was on the property on the day in question and that Mr Hall was not. “He’s a liar. He is a liar,” Dean Martin said at the hearing. “He is Donovan and I don’t even know the gentleman’s last name “But the fellow who is putting my family through this is a liar.” The court also heard from Donald Newman, who worked for Mr Martin and gave evidence of his practice of paying workers cash-in-hand. Justice Mossop ultimately found that Mr Martin had employed Mr Hall and that the accident had occurred as alleged. He found Mr Hall to be a reasonably credible witness, and described Mr Martin as “argumentative” and “clearly hostile”. “[Mr Martin’s] approach to the proceedings overall appeared to be inconsistent with what one would have expected from an honest businessman who was uninsured at a relevant time,” the judge said. “… He demonstrated a willingness to tailor his evidence in a way that would advance what he perceived to be his interests in the proceedings.” Justice Mossop said Mr McDonald had been negligent in his operation of the crane, and Mr Martin as his employer was “vicariously liable”. The judgment set out medical evidence from two doctors, both of whom considered Mr Hall to have “significant incapacity for work” as a result of the incident. Justice Mossop described the fractured patella suffered by Mr Hall as “very nasty”, and said there was a significant possibility that he may require a total knee replacement. The total of $532,365 in damages is comprised of eight elements including $95,812 for past economic loss and $237,240 for future wage loss.
